5.   Is other personal data collected and used?

In all other cases, we only collect and process your personal data where you have voluntarily given us your permission to do so or if you want to use specific services for which we need your personal data. Art. 6 (1) b) GDPR or, respectively, Art. 6 (1) a) GDPR provides the legal bases for processing.

This can be, for example, when you fill out a registration form or send us an e-mail, order products or services, send inquiries or request material. Provided that no other legal obligations are in place, we will use your personal data only for the purposes for which you gave us your consent.

6.   Will my personal data be passed on to third parties, e.g. government authorities?

At advanceING, only people who are responsible for fulfilling contractual and legal obligations will receive your data. Some data will need to be passed on under strict contractual and legal conditions:

  • Due to a statutory obligation:

In some cases, we are legally obligated to pass on data to government institutions where requested by them.

In accordance with § 101 of the copyright law, when presented with a court order we are obliged to provide information about customers to holders of (ancillary) copyrights where the customer has supposedly offered copyright-protected works on exchange platforms. In such cases the transmitted information contains the login name of the IP address allocated on the requested date and, if known to us, the name and address of the customer.

In all other cases personal data will only be forwarded to government institutions and authorities in accordance with obligatory national legal regulations or where it is necessary to forward the data for law enforcement purposes in the event of attacks on the network infrastructure. Art. 6 (1) c) GDPR or, respectively, § 24 (2) No 1 BDSG (German Federal Data Protection Act (FDPA)) provides the legal basis for processing.

  • To external service providers for data processing:

If a service provider comes into contact with personal data of our customers, this usually occurs within the context of the so-called order processing of personal data. This is expressly provided for by law. In this case, DRSP will still be responsible for the safety of your personal data – in addition to the processor, where appropriate. The service provider works exclusively according to our instructions, which we guarantee by means of strict contractual regulations, technical and organizational measures and additional monitoring.

As a service provider, advanceING, represented by Dr. Schmidt & Partner Ltd (DRSP), uses internal and external processors. These are companies of DRSP as well as service providers in the fields of IT services (e.g. for technical and administrative tasks and usage analysis) and telecommunication services.

The order processing of personal data bound by instructions complies with statutory data protection regulations.

  • To companies of DRSP:

advanceING might send your personal data to companies of DRSP for the purpose of conducting a business relationship or safeguarding legitimate interests.

If data is transferred to foreign countries, these countries are located in the EU, the EEA or in a country which has an appropriate privacy standard in accordance with the resolution of the EU Commission. If data is transferred by companies of DRSP to companies which are located in other states, advanceING will guarantee that the data-importing companies are committed to an appropriate level of data protection.

Above and beyond this, we will not transfer any data to third parties unless you have given us your express permission to do so, unless the transfer is necessary to perform the work or service requested by you, or unless it is prescribed by law. Any further transfer of your data to third countries or international organizations is not intended.

7.   How long will my data be stored?

We store data for as long as this is required by law or necessary to provide the service requested by you or for as long as you have given us your consent to do so.

8.   Do I have a right of access to and rectification of the data stored under my name? Which other rights am I entitled to with regard to the data stored under my name?

You can obtain information on the scope, origin and recipient of the stored data as well as the purpose for storing it at any time free of charge. Additionally, in accordance with the data protection regulations, you have the right to have your data rectified, erased or the processing thereof restricted, the right to object to the processing of your data and the right to data portability. Please note that you also have the right to lodge a complaint with a regulatory authority.
